New IRS Form Proves President Fibbed About Individual Mandate Tax...

On Thursday the IRS released a slew of draft 2014 tax forms. The new draft Form 1040 shows a new surtax line has been created for the payment of the individual mandate surtax – see line 61 of the 1040

President Obama has repeatedly denied that the surtax is in fact actually a tax. The most prominent example was a heated exchange on ABC’s This Week in Sept. 2009, when George Stephanopoulos confronted Obama with a dictionary...

◼ ANDVIDEO: Obamacare architect admits subsidies limited to state-run exchanges...Democrats try to deny - Reason

Earlier this week, a three-judge panel in the D.C. Circuit Court ruled that, contrary to the Obama administration’s implementation and an Internal Revenue Service rule, Obamacare’s subsidies for private health insurance were limited to state-run health exchanges.

The reasoning for this ruling was simple: That’s what the law says. The section dealing with the creation of state exchanges and the provision of subsidies states, quite clearly, that subsidies are only available in exchanges "established by a State," which the law expressly defines as the 50 states plus the District of Columbia.

Obamacare’s defenders have responded by saying that this is obviously ridiculous. It doesn’t make any sense in the larger context of the law, and what’s more, no one who supported the law or voted for it ever talked about this. It’s a theory concocted entirely by the law’s opponents, the health law's backers argue, and never once mentioned by people who crafted or backed the law....

Plea to America: Melt Congressional Phones, Kill Executive Amnesty...

The Obama administration is preparing to effectively "nullify" the immigration laws of the United States through an executive action, says one Republican senator. As Time reported Thursday, President Obama appears prepared to provide millions of illegal immigrants living in the U.S. work authorization via executive orders:
When President Obama issues executive orders on immigration in coming weeks, pro-reform activists are expecting something dramatic: temporary relief from deportation and work authorization for perhaps several million undocumented immigrants. If the activists are right, the sweeping move would upend a contentious policy fight and carry broad political consequences.

The activists met privately with the President and his aides June 30 at the White House, and say in that meeting Obama suggested he will act before the November midterm elections....
Plea to America: Melt Congressional Phones, Kill Executive Amnesty - BREITBART

Sessions wants Americans to melt Congress’ phone lines, demanding their members make a precondition of any border crisis bill that Obama’s executive order amnesty via the Deferred Action for Childhood Arrivals (DACA) and any future plans be stopped.

“The American people have begged and pleaded for years for our laws to be enforced,” Sessions said in his statement. “We have people in our own country living in violence, fear and poverty every single day. They have demanded an immigration policy that puts their jobs, wages and communities first. Every citizen should pick up the phone and ask of their congressional representative: where do you stand?”

Sessions said that it would be wrong for any member of the House or Senate to support any border crisis bill that doesn’t end DACA and block the president from expanding it.

“No Member—House or Senate, Democrat of Republican—should support any bill with respect to the border crisis that does not include language explicitly prohibiting the Administration from taking such action,” Sessions said. “Congress must foreclose any possibility of these unlawful executive actions before congressional funding is granted. This is an essential precondition.”

4 Ways the Fourth Amendment Won't Protect You Anymore

At the border, online, at the doctor’s office, you’re no longer protected from unreasonable search and seizures. - Peter Van Buren/Mother Jones

Here's a bit of history from another America: the Bill of Rights was designed to protect the people from their government. If the First Amendment's right to speak out publicly was the people's wall of security, then the Fourth Amendment's right to privacy was its buttress. It was once thought that the government should neither be able to stop citizens from speaking nor peer into their lives. Think of that as the essence of the Constitutional era that ended when those towers came down on September 11, 2001. Consider how privacy worked before 9/11 and how it works now in Post-Constitutional America....

While the NSA's electronic basket of violations of the Fourth Amendment were, pre-Snowden, meant to take place in utter secrecy, here's a violation that sits in broad daylight: since 2002, my doctor can disclose my medical records to the NSA without my permission or knowledge. So can yours.

Congress passed the Health Information Portability and Accountability Act (HIPPA) in 1996 "to assure that individuals' health information is properly protected." You likely signed a HIPPA agreement at your doctor's office, granting access to your records. However, Congress quietly amended the HIPPA Act in 2002 to permit disclosure of those records for national security purposes. Specifically, the new version of this "privacy law" states: "We may also disclose your PHI [Personal Health Information] to authorized federal officials as necessary for national security and intelligence activities." The text is embedded deep in your health care provider's documentation. Look for it.

How does this work? We don't know. Do the NSA or other agencies have ongoing access to the medical records of all Americans? Do they have to request specific ones? Do doctors have any choice in whose records to forward under what conditions? No one knows. My HMO, after much transferring of my calls, would ultimately only refer me back to the HIPPA text with a promise that they follow the law.

The Snowden revelations are often dismissed by people who wonder what they have to hide. (Who cares if the NSA sees my cute cat videos?) That's why health-care spying stands out. How much more invasive could it be than for your government to have unfettered access to such a potentially personal and private part of your life—something, by the way, that couldn't have less to do with American "security" or combating terrorism.

Our health-care providers, in direct confrontation with the Fourth Amendment, are now part of the metastasizing national security state. You're right to be afraid, but for goodness sake, don't discuss your fears with your doctor....

ISIS expelled all Christians from the historic city over the weekend after the people were told to convert to Islam, pay a tax, or die. The majority of Christians left with only the clothes on their back, and ISIS marked homes with an “N” for Nazarene. ISIS is also cutting off water supplies to Christian and Kurd communities they do not control.
“This is ethnic cleansing, but nobody is speaking up,” said Yonadam Kanna, Iraq’s most prominent Christian politician. “It is the first time in our history that something like this has happened. Muslims and Christians used to live together.”

Feds fight to keep White House e-mails secret in Breitbart-Sherrod libel suit...

The Obama administration is fighting to keep secret hundreds of pages of emails detailing White House involvement in the 2010 firing and attempted rehiring of Agriculture Department employee Shirley Sherrod after the late conservative blogger Andrew Breitbart published a blog post and video clips suggesting Sherrod was a racist. - Politico

"The parties to this case have no need for 'public access to the documents at issue' because they can litigate under seal any issue to which those documents are relevant. Neither does the public at large have any need for access to those documents. As the United States has acknowledged in this case, plaintiff’s resignation from USDA 'implicate[d] sensitive issues and significant public interest," DOJ lawyers Charles Glass and Arthur Goldberg wrote. "Those matters have already been addressed, however, by the statements about plaintiff made by Secretary of Agriculture Thomas J. Vilsack and by then-White House Press Secretary Robert Gibbs at or about the time of plaintiff’s resignation. Those matters have also been addressed by the thousands of pages of documents dealing with plaintiff that USDA has produced to the public pursuant to [the Freedom of Information Act]."

Assemblyman Tim Donnelly's 'Initiative Transparency' Bill Signed Into Law

The initiative process gives the People a means of direct control over their government and has allowed them to enact many important reforms over the past century. The right of initiative is reserved by the People under our Constitution and has been described by the courts as one of the most precious rights of our democratic process. With his signature on AB 2439, Governor Brown chose to uphold and strengthen the reserve right of the people to directly petition their government.

A Cut Above

Some time ago I got a tweet from a young lady who informed me that she was sure that I was not paying my "fair share" and although she could neither tell me what my fair share would consist of or knew anything about the amount of tax and other state and federal assessments I pay, she was sure it was not enough and I should be forced to pay more. - Charlie Daniels/CNS

She said she had a hard time getting ahead and she seemed to think that part of the reason for that was because people like me did not pay their fair share of taxes so that people like her could get the government aid they were entitled to, to level the playing field, she also informed me not to tell her to "try harder" because she had done that and it simply didn't work.

At this point, I gave up even trying to reason with her, even though I wanted to tell her that, with the attitude she had, she was never going to achieve any higher position in life than she already had, for the simple reason that she had swallowed the one-size-fits-all, you-didn't-build-that, "somebody helped you," "the reason you don't prosper is because somebody else is unfairly taking your piece of the pie" socialistic crap.

In a potentially crippling blow to Obamacare, a top federal appeals court Tuesday said that billions of dollars worth of government subsidies that helped nearly 5 million people buy insurance on are illegal.

A judicial panel in a 2-1 ruling said such subsidies can be granted only to those people who bought insurance in an Obamacare exchange run by an individual state or the District of Columbia — not on the federally run exchange

The Obama Administration is certain to seek a reversal of the decision by the U.S. Court of Appeals for the District of Columbia Circuit, which does not immediately have the effect of law.

The ruling endorsed a controversial interpretation of the Affordable Care Act that argues that the subsidies are illegal because ACA does not explicitly empower a federal exchange to offer subsidized coverage, as it does in the case of state-created exchanges. Subsidies for more than 2 million people who bought coverage on state exchanges would not be affected by Tuesday's ruling if it is upheld.
